Fertility Clinic Denies Legal Liability for Loss of Frozen Eggs and Embryos

The Cleveland-area fertility clinic where more than 4,000 frozen eggs and embryos were lost earlier this year due to a freezer malfunction is denying legal liability.

After the March incident, University Hospitals apologized to the hundreds of fertility clinic patients who lost eggs or embryos, CBS News reported.

Dozens of families are suing University Hospitals, which has responded by saying clients signed consent forms acknowledging they were aware of the risks.

“Plaintiffs were fully advised of the material risks, benefits and alternatives available for treatment and thereafter voluntarily assumed and consented to those risks,” University Hospitals says in court documents released this week, CBS News reported.

University Hospitals said it’s improved operations and equipment at its fertility center, including adding staff and doing more training.
