Real estate appellate tribunal rules framed

The Tamil Nadu Real Estate Appellate Tribunal has framed regulations of its own practice and procedure, stressing on the need for digitisation of records of the Tribunal within two months from the date of disposal of appeals.

The regulations have come into force from Monday, the day of uploading on the website of Tamil Nadu Real Estate Regulatory Authority. The regulations would apply to all the proceedings pending in the Tribunal on the date of their commencement, offering home buyers various regulatory benefits, including defect liability and penal action against builders who fail to handover projects on time.

The regulations would be applicable for Tamil Nadu and the Union Territories of Andaman and Nicobar Islands and Puducherry.

Every appeal, petition, or counter statement should be in English and in case it is in some other Indian language, it should be accompanied by a copy of the English translation. The Tribunal will publish causelist monthly, weekly or daily. The calendar of days of working of the Tribunal in a year would follow that of the calendar of the Madras High Court.

The sitting of the Tribunal on the days of enquiry would be between 10.30 a.m. and 1.30 p.m. and after lunch between 2.30 p.m. and 4.30 p.m. The sitting of the Tribunal would be at Chennai or such other places within its jurisdiction as may be decided by the Chairperson. Only during the summer vacation, a vacation bench is likely to be constituted by the Chairperson, sitting once a week. The office of the Tribunal would remain open on all working days from 10 a.m. to 5.45 p.m.

In the absence of the chairperson or vacancy of the chairperson, the other two members would conduct the proceedings of the Tribunal. In such cases, the judicial member will act as chairperson.

All material records shall also be destroyed after five years from final conclusion of the proceedings or two years from the date of disposal of appeals.
