The Motor Accidents Claims Tribunal, Chennai has directed an insurance firm to pay a compensation of ₹34.13 lakh to vegetable and fruit vendors affected by a road accident.
According to petitions, M. Buvaneswari, Krishnavani and Sathya were travelling in a mini lorry carrying vegetables from Koyambedu market to Thiruporur.
“In an accident Buvaneswari sustained grievous injuries and Krishnavani and Sathya died on the spot,” it said.
Buvaneswari and family members of Krishnavani and Sathya filed separate petitions seeking compensation. The Tribunal held that the accident occurred due to the rash and negligent driving of the driver and directed the insurance firm to pay a compensation of ₹2,11,700 to Buvaneswari₹9,07,000 to Krishnavani’s kin and ₹22,95,000 to Sathya’s family.
“At the time of accident, there was an insurance coverage. Since there is a violation of policy conditions, being the insurer of the vehicle, the insurance firm is liable to pay compensation to the petitioners and to recover the same from the owner of the vehicle,” the Tribunal said.
